Many people assume spousal maintenance is automatic. It is not.

South African courts consider factors such as:

  • Duration of the marriage
  • Standard of living during the marriage
  • Each spouse’s financial means and earning capacity
  • Age and health of the parties
  • Contributions made during the marriage (including as homemaker)

Spousal maintenance is a discretionary remedy, not a right, and is assessed case by case.
