Customary marriages are legally recognised in South Africa under the Recognition of Customary Marriages Act. Legal issues often arise regarding:

  • Registration of the marriage
  • Whether the marriage is in or out of community of property
  • Polygynous marriages
  • Divorce and property division

A customary marriage does not automatically dissolve if spouses separate informally. A formal legal process is required.
